Terms of Service

These terms govern your use of the Olearna platform. By creating an account or using our services, you agree to these terms.

1. Acceptance of Terms

By accessing or using Olearna ("the Platform"), operated by Olearna ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents or guardians who create accounts for their children accept these Terms for both themselves and their child.

2. Account Registration and Eligibility

2.1 Eligibility

Olearna is available to users in Ghana and other countries where our services are offered. Students of any age may create accounts, though we recommend that students under 13 do so with the involvement of a parent or guardian.

2.2 Account Types

Olearna offers the following account types:

• Student accounts: For students preparing for BECE or WASSCE
• Parent accounts:For parents or guardians who want to track their child's readiness
• Teacher accounts:For teachers who want to monitor their students' progress
• School accounts: For schools that subscribe on behalf of their students

2.3 Account Responsibilities

You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your login credentials
• All activity that occurs under your account, whether or not you authorised it
• Notifying us immediately if you suspect unauthorised use of your account

3. Subscription and Payments

3.1 Free Tier

Olearna offers a free tier that includes access to a diagnostic test and your readiness label for each subject. The free tier is subject to limitations including restricted access to practice questions, mock exams, and advanced features.

3.2 Paid Plans

Paid subscription plans unlock full access to practice questions, mock exams, detailed progress reports, and other premium features. Plan details and pricing are displayed on our pricing page and may be updated from time to time.

3.3 Payment Methods

Payments are processed through mobile money services including MTN Mobile Money (MoMo), Vodafone Cash, and AirtelTigo Money. By making a payment, you authorise the applicable mobile money provider to debit your account for the subscription amount.

3.4 Billing and Renewal

Subscriptions are billed on a recurring basis (monthly or termly, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will send a reminder before each renewal.

3.5 Refunds

You may request a full refund within 7 days of a new subscription purchase. After 7 days, refund requests are handled on a case-by-case basis. To request a refund, contact us at support@olearna.com.

4. Free Tier Limitations

The free tier provides:

• One diagnostic test per subject
• Readiness labels for all tested subjects
• Limited access to practice questions

The free tier does not include:

• Unlimited practice questions
• Full mock exams
• Detailed topic-level progress reports
• Priority support

We reserve the right to modify the features included in the free tier at any time.

5. Acceptable Use Policy

When using Olearna, you agree not to:

• Share your account credentials with others or allow multiple people to use a single account
• Copy, reproduce, distribute, or publicly display questions, answers, or other content from the Platform
• Use automated tools, bots, or scripts to access the Platform or extract content
• Attempt to reverse-engineer, decompile, or otherwise access the source code of the Platform
• Interfere with or disrupt the Platform's infrastructure, servers, or networks
• Use the Platform for any unlawful purpose or in violation of any applicable Ghanaian law
• Impersonate another person or misrepresent your identity or affiliation
• Upload or transmit viruses, malware, or other harmful code

Violation of this acceptable use policy may result in suspension or termination of your account without refund.

6. Intellectual Property

6.1 Our Content

All content on the Platform - including questions, answers, explanations, readiness algorithms, user interface designs, logos, and text - is the intellectual property of Olearna or its licensors. This content is protected by copyright and other intellectual property laws of Ghana and international treaties.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial educational purposes. This licence does not include the right to:

• Reproduce or redistribute Platform content
• Use Platform content for commercial purposes
• Create derivative works based on Platform content

6.3 Your Content

You retain ownership of any content you submit to the Platform (such as feedback or support messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, modify, and display that content in connection with operating and improving the Platform.

7. Limitation of Liability

To the maximum extent permitted by Ghanaian law:

• Olearna is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components
• We do not guarantee specific exam results or outcomes from using the Platform. Readiness labels are based on practice performance and are indicators, not predictions
• Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages

8. Termination

8.1 By You

You may cancel your subscription and delete your account at any time through your account settings or by contacting support. Upon cancellation, you retain access to paid features until the end of your current billing period.

8.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Platform in a way that harms other users or our operations. We will provide notice before termination except in cases of severe violations.

8.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. We will handle your data in accordance with our Privacy Policy.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ghana.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Platform or via email at least 14 days before the changes take effect. Your continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Olearna regarding your use of the Platform. They supersede any prior agreements or understandings, whether written or oral.
